You know the obvious behaviors that describe someone who's healthy and takes care of themselves. A healthy person doesn't smoke, tries to maintain a healthy weight, eats healthy foods with plenty of fruits, vegetables and fiber and, of course, exercises on a regular basis.
Then there are other elements to add to the list.
Consumer Reports: What Information Furnishers Need to Know
A healthy person also knows how to manage stress, gets good quality sleep each night, doesn't drink too much, doesn't sit too much When you look at everything that could possibly go into a healthy lifestyle, you can see just how hard all of those things are in our current world. The good news is, you don't have to change everything at the same time.
In fact, the trick to healthy living is making small changes - Taking more steps each day, adding fruit to your cereal, having an extra glass of water or saying no to that second helping of buttery mashed potatoes. Physicists and scientists proved this long ago. What is true on a large scale for our universe is also the case for every living organism.
Each cell in our body has its own vibration frequency. This is the basis for the work the cells carry out: detoxifying and nourishing.
Our metabolism functions better when we have a healthy lifestyle and the substances we take in are of good quality: the optimum amount of clean, living water and a diet of unadulterated sun-ripened food. We have discovered natural principles and applied these to the biological processes of the human body — with spectacular success! If you report information about consumers to consumer reporting agencies CRAs — like a credit bureau, tenant screening company, or check verification service — you have legal obligations under the Fair Credit Reporting Act's Furnisher Rule.
Your responsibilities include:. The rules are identical in substance.
Consumer Compliance Outlook
You have "reasonable cause to believe" that information is inaccurate if you have knowledge, other than allegations from the consumer, that would lead a reasonable person to doubt the accuracy of the information. FCRA Section a 1 A You may be exempt from this requirement if you give an address for consumers to report inaccurate information, but you cannot, under any circumstances, report information the consumer has told you is inaccurate if it is, in fact, inaccurate.
You must establish and implement written policies and procedures regarding the accuracy and integrity of information you furnish to a CRA. Read the Appendix; the information here is just a sample.
If you furnish information to a CRA on a regular basis and determine that any information you provided is inaccurate or incomplete, you must promptly notify the CRA and provide corrections or additions. Going forward, you must furnish only the correct information to the CRA. FCRA a 2 B. The FCRA requires that if you furnish any information to a CRA, you must include any of the following items that are applicable to you.
Appendix A I. Disputed Information — Once a consumer disputes information, you may not report that information to a CRA without telling the CRA that the information is in dispute.
FCRA a 3. Closed Accounts — If you furnish information to a CRA on a regular basis, you must notify the CRA that a consumer has voluntarily closed an account the next time you send information that would normally include that account. This is important because some users of information may interpret a closed account as an indicator of bad credit unless you clearly disclose that the consumer, not the creditor, closed the account. FCRA a 4. Delinquent Accounts — When you refer an account for collection and notify a CRA that you have done so, you also must report the date of delinquency to the CRA within 90 days.
The date of delinquency is the month and year the consumer's delinquency resulting in the referral began, see the examples below. FCRA a 5 A. If you are a debt collector furnishing information to a CRA about the accounts of a creditor, you must report the date of delinquency given to you by the creditor.
FCRA a 5 A This "date of delinquency" determines how long the debt can be reported on a consumer's credit report. Generally, a CRA may report a delinquent debt for seven years from the date of delinquency. If the debt was discharged in bankruptcy, however, a CRA may report it for 10 years. The creditor places the account for collection on October 1, In this case, the date of delinquency is March The date that the creditor places the account for collection is not the basis for calculating the delinquency date.
Mary makes partial payments for the next five months, but never brings the account current. The creditor places the account for collection in January Because the account was never brought current during the period partial payments were made, the delinquency that immediately preceded the collection began in Aprilwhen Mary first became delinquent.
The correct delinquency date is April Skip to main content. Menu Search Account. Share and vote on pregnancy symptoms. Search form Search. Please Help! Connect With Us.Consumer reports and credit scores have become an indispensable tool for creditors, not only when evaluating credit applications and setting credit terms and conditions but also during account review for existing accounts. Because the information that furnishers provide to consumer reporting agencies CRAs can have significant consequences for consumers, Congress created consumer protections for furnished information.
Part Section First, a furnisher must designate accounts to reflect both spouses' participation in the following circumstances: for new accounts when the spouse is an authorized user or is liable on the account except as a guarantor, surety, endorser, or similar party ; and for existing accounts when one of the spouses makes a written request to reflect both spouses' participation on the account.
In the latter situation, the furnisher must make the designation within 90 days after receiving the written request. Second, when an account is designated to reflect the participation of both spouses, the information must be furnished to the CRAs in a way that enables the CRAs to provide access to the information in the name of each spouse. Finally, when a creditor receives an inquiry about an account that reflects the participation of both spouses, the creditor must furnish the information in the name of the spouse for whom the request is made.
Upon discovering the error, the furnisher must correct it as soon as possible. In fact, during the period leading up to the amendments, the FTC [Federal Trade Commission] consistently indicated that it received more complaints about consumer report errors than any other item.
Inaccurate Information. Duty to Correct and Update Information.
A furnisher that regularly furnishes information to CRAs is also required to notify a CRA if it has determined that previously furnished information is not complete or accurate and to correct that information.
Duty to Provide Notice of Dispute. When a consumer disputes the completeness or accuracy of furnished information, the furnisher must note the dispute to the CRAs when furnishing the information. Duty to Provide Notice of Closed Accounts. Furnishers that regularly furnish information to CRAs must notify the CRAs when a consumer voluntarily closes a credit account.
Such an assumption could result in the denial of credit to a consumer. Duty to Provide Notice of Delinquency of Accounts. When an account is placed for collection, is charged to profit or loss, or a similar action is taken, and that delinquency is furnished to a CRA, the furnisher must notify the CRA of the date of delinquency on the account no later than 90 days after furnishing the information.
See S. Identity Theft. In addition, when a consumer submits an identity theft report to a furnisher indicating that furnished information resulted from identity theft, the furnisher may not report the information to the CRAs unless the furnisher subsequently knows or is informed by the consumer that the information is correct. Negative Information. If a financial institution that extends credit and regularly furnishes information to a nationwide CRA furnishes negative information to the CRAs about a consumer credit extension, it must provide a clear and conspicuous written notice to the consumer indicating that it furnished negative information to the CRAs.
The notice must be provided to the consumer no later than 30 days after furnishing the negative information. After providing the notice, the financial institution is not required to send the consumer additional notices if it furnishes additional negative information to the CRAs about the same transaction, credit extension, account, or consumer.
See Appendix B of Regulation V. In addition to establishing accuracy requirements, the FCRA requires furnishers to investigate consumer disputes filed with the CRAs about information the furnishers provided.
Investigation Procedures. If the furnisher determines that the information it provided was incomplete or inaccurate, it must notify all nationwide CRAs to which the information was furnished of its findings.
Section of the FACT Act expands furnishers' affirmative duties concerning the accuracy and integrity of the information they furnish, contains a provision that allows consumers to file disputes directly with the furnishers, and specifies the procedures furnishers must follow in responding to direct disputes. Under the regulations implementing this provision, when a consumer files a direct dispute, a furnisher is required to investigate if the dispute relates to any of the following issues: 1 the consumer's liability for a credit account or other debt with the furnisher; 2 the terms of a credit account or other debt with the furnisher; 3 the consumer's performance or other conduct concerning an account or other relationship with the furnisher; or 4 any other information contained in a consumer report for an account or other relationship with the furnisher that bears on the consumer's creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living.
